You have requested that Migrationsverket decide your case – or received a decision on such a request. This is how the process works.
What the letter means
If your case has not been decided within six months you can in writing request a decision under Section 12 of the Administrative Procedure Act. The authority must then either decide the case or reject your request in a separate decision within four weeks.
A rejection of the request does not mean your application was refused – only that Migrationsverket believes it needs more time. The rejection can be appealed to the Migration Court.
What you need to do
- 1The request can be made at the earliest six months after you submitted the application, and only once per case.
- 2Send the request in writing with your case number – form available from Migrationsverket, or use the e-service.
- 3Wait for a response: within four weeks the case should be decided or the request rejected.
- 4If the request is rejected: consider appealing the rejection to the Migration Court according to the instructions in the decision.
Common questions
Can the request affect my case negatively?
No, a request for a decision does not affect the substantive assessment. It can however lead to the case being decided on existing material – make sure your application is complete first.
What happens if the court upholds my appeal?
The Migration Court can order Migrationsverket to decide the case as soon as possible. That often has effect within a short time.
Can I request several times?
No, a request under Section 12 of the Administrative Procedure Act can only be made once per case.
